Terms of Service – Skepri

§ 1. General provisions

  1. These Terms of Service ("Regulations") are available in the Polish language and constitute the basis for the use of the "SKEPRI" Online service ("Service"), available at www.skepri.com
  2. The Service is operated by Skepri Dominik Miśkiewicz, with registered office at al. Jana Pawła II 27 00-867 Warsaw, Poland ("Owner").
  3. The Service enables users ("Users") to use the service of mock remote interviews using artificial intelligence tools.
  4. Any claims, disputes or misunderstandings arising from the use of the Service will be settled by the Polish court according to the Owner's jurisdiction. This clause does not exclude or limit the right to bring proceedings against any User in any other court of competent jurisdiction.
  5. By using the Service, the User agrees to these Regulations. If the User does not agree with any of the provisions of these Regulations, he/she may not use the Service.
  6. The Service may update the Regulations. The User will be notified each time of such changes via the email address provided during registration or by an announcement on the Service. The changes will apply to your access and use of the Service after such notification. Your continued access to and use of the Service following such notification constitutes your agreement to be bound by the new Regulations.

§ 2. User’s account

  1. Without registering an Account, the Internet user has access to the website.
  2. In order to use the Service, the user may create an account on the Service ("Account") and concludes an agreement with the Service.
  3. Each User has the possibility of creating an Account in the Service.
  4. The procedure for creating an Account involves providing an e-mail address.
  5. The User is obliged to agree to the processing of personal data and to accept the Regulations and Privacy Policy.
  6. User’s permission to access and use the Service is personal and not transferable or assignable.
  7. If the User loses their login details or is unable to access the Account for any other reason, the Owner shall not be liable for any loss arising from these circumstances. It is the User's responsibility to secure their login details and keep them in a safe place. A User who has lost their login details may contact the Service to recover them.
  8. If the User's Account is likely to be compromised or if the User misuses the Service using the Account, the Service may require the User to reset their password or suspend their Account.
  9. Each User may deactivate and delete their Account at any time. Upon deactivation of the Account, all data in the Account will be deleted. The Service shall not be liable for any loss in this respect.
  10. The Service reserves the right to delete or temporarily suspend any User Account, in particular due to:
    1. distribution or publishing any content that is false, inaccurate, unlawful, harassing, defamatory, misleading, offensive, threatening, harmful, violent, obscene, vulgar or otherwise objectionable,
    2. access information not intended for the User or to access a server or account to which the User is not entitled;
    3. interference with or disruption the operation of the Service, servers or networks used to provide the Service or violate any requirements, procedures, policies or regulations of such networks;
    4. creation of a database by systematically downloading and storing content available on the Service,
    5. selling, promoting or advertising products or services;
    6. advertising sexual services or seeking employees for positions of that nature;
    7. misuse of the Website
    8. actions detrimental to the good name of the Service.
    9. exploitation of system gaps in the Service,
    10. violation of the Regulation.
The Service reserves the right to delete or suspend a User's account without prior notice and warning.

§ 3. Procedure for using the service

  1. After creating an Account and logging in, the User can use the option to start a new interview ("Interview") by selecting one of the interviews from the main page, or creating a new interview by providing the name of the company, the name of the position and the job description, after which the User should follow the instructions of the Service using the appropriate settings to prepare the Interview.
  2. Once a new interview has been initiated, the Service will generate a link to the Conversation.
  3. User does not need to create an account on the Service to participate in the interview.
  4. The Candidate, using a link from the User, may proceed to the interview at any time.
  5. At the end of the Interview, the User will receive an automatically generated report describing their performance and advice on how to improve.

§ 4. Liability

  1. User acknowledges and agrees that Owner is solely a provider of the Service and is not involved in the interviewing process. Users are solely responsible for compliance with all applicable laws regarding the use of the Service for such activities.

§ 5. Copyrights

  1. The Owner and/or its licensors are the sole owners of all rights in the layout, codes, structure and organisation of the Service, including trade secrets, intellectual property, and all other rights. It is prohibited to copy, distribute, publish, modify or translate any part of the Service.
  2. The domain www.skepri.com is the sole property of the Owner.
  3. All the contents of the Service, including in particular, but not exclusively, images, graphics, photographs, animations, videos, transmissions, music, sounds, texts, terms and conditions, belong exclusively to the Owner or its partners and are protected by intellectual property rights or other laws. By using the website, the User does not acquire any rights to its content.
  4. The User acknowledges and understands that any User Content is the sole responsibility of the person from whom the User Content originated.
  5. User Content that the User uploads or otherwise makes available on the Service must not contain:
    1. keywords that are confusing, illegible, hidden, repetitive or irrelevant to the job posting;
    2. names, logos or trademarks of unrelated persons, unless the necessary consent has been obtained from them; and
    3. information that is false, misleading or inaccurate.
  6. By uploading, publishing, displaying or otherwise providing content such as an advertisement description, company name, job title, the User grants the Owner a worldwide, non-exclusive, royalty-free licence to reproduce, adapt, distribute and publish such User content for the purpose of performing the services of the Service.

§ 6. Service availability

  1. The Owner will make every effort to ensure that the Service is available at all times. However, he cannot guarantee that the Service or any part or feature of the Service will always be available or free of errors. Any problems will be rectified as soon as possible.
  2. Access to the Service may be temporarily restricted to allow for repairs, maintenance or updates to the Service.

§ 7. Final provisions

  1. The User may not assign or transfer any of its rights under this Agreement to any other person. The User agrees that the Owner may assign or transfer its rights under this Agreement at its sole discretion if it has a reasonable belief that the User's rights will not be affected.
  2. If any provision of these Regulations shall be invalid, illegal or unenforceable to any extent by operation of law or shall otherwise be or become ineffective for any reason not attributable to the Owner, the validity, legality and enforceability of the remaining provisions of these Regulation shall not be affected in any way.
